eric cal sw -- swalwell. michael montgomery, reporter for kqed and center for investigative reporting, and moore, professor of law. the u.s. supreme court convened today behind closed doors discussing whether or not to review a lower court ruling striking down california's proposition 8. their highly anticipated decision could come monday. as you well know, the supreme court gets seven to eight thousand requests for cases to be reviewed. how do they decide? they only pick 80 or so a year. what is the criteria and why would prop 8 be an important one to look at? >> it's how legal the precedent is and how national the question is, how many people it affects, and relatedly, how much lower courts are struggling over that and related questions. so in the prop 8 case, it's true the prop 8 is a california-specific measure, and it's also true that a ninth circuit ruling tried to make its ruling non-specific. california is such an important state and it occurs in dozens of other states and that's why it might have some appeal for the supreme court. >> as you said, the ninth circuit narrowed it

central cal sxal into central oregon this is where we're looking at perhaps some of the heaviest rainfall totals. look at the sustained winds. between 25 and about 35, but some of those higher peaks are expecting some wind gusts right around 120 miles an hour, and they're saying, well, that will decrease tonight to around 80 or 90
incredibly low last year. office max got put through the metaphor cal meat grinder. it was horrible. falling from $17 to $4. as the company came into 2012 the ball was set very low. when the expectations are that low, even lousy results can take the stock hire as long as they aren't downright pitiful. last year sales nowhere near good. but in line with the street's expectations and not absolutely hard which was good enough to give the stock some lift at these levels. even though max has rallied this year, it climbed from $17. it still has a way to go before it's back to even. when you look at it in that context, this rally doesn't seem insane. office max has been trying to get its house in order. it announced it was reinstating its two cent per share quarterly dividend. not much. the stock yields about 1%. it also told us it was conducting a comprehensive capital allocation review. designed to simplify its balance sheet. a couple of important elements here. office max got caught up in the terrible lehman bankruptcy. they had bonds backed by lehman connected to timber assets. the courts resol

manager on how they view amtrak's work with california and cal trans. they are concerned with changes to state support services program, section 209 of the passenger rail investment and improvement act, the priia. that forces the state of california to pay $20 million that are going to be taken out of that budget for them. it runs along the border of my area which is the alameda corridor east which is a train transportation that brings in to the rest of the nation. we are watching the reorganization of amtrak, making sure it doesn't hinder any state partnerships. these are critical because they are the ones who will in the end work with the local communities to ensure that we get more people to utilize it. we are pleased that the reorg has created an executive level position of general manager. i look forward to meeting that individual and working with him. it's a very positive step and the states provide 50% of the revenues to amtrak. we must have a senior amtrak level position to work with state on their programs. and this is especially important, section 209 of priia negatively imp
